The regime

UK crypto firms currently operate under FCA cryptoasset registration β€” an AML/CTF regime in force since January 2020, with a famously high failure rate for applicants. The full FSMA-based regime, legislated in 2025, brings exchanges, dealing, custody and stablecoin issuance inside the regulatory perimeter with proper authorisation requirements, with FCA rulebooks phasing through 2026.

Post-Brexit, no EU passport reaches the UK: MiCA authorisation does not cover British customers, and UK registration confers nothing in the EU. Firms serving both markets need both.

Can an EU MiCA licence be used in the UK?

No. The UK left the EU passporting system; MiCA authorisation confers no UK permissions. Firms need FCA registration now and FSMA authorisation as the new regime phases in.

When does the full UK crypto regime start?

The legal framework was made in 2025 and the FCA is consulting and finalising rulebooks through 2026, with authorisation gates opening in phases. Registered firms are expected to transition rather than start from zero.
